01Acceptance of Terms
My Harvest List ("My Harvest List," "we," "us," or "the Platform") operates myharvestlist.com, an independent travel-planning utility for Woodinville wine country. By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and continued use after changes constitutes acceptance of the revised Terms.
Businesses and paid partners additionally confirm acceptance of these Terms — including the billing, cancellation, and non-compete provisions — by completing the checkout process. Checking the agreement box at checkout constitutes a binding clickwrap acceptance under Washington contract law.
02Description of Service
The Platform lets visitors browse Woodinville-area venues, "pluck" venues into a personal trip basket, build a shareable itinerary, and view venue profile pages. The Platform is provided free to consumers and requires no account.
We offer paid participation levels to businesses and partners as described in Section 05. Information presented about venues is aggregated and provided for planning convenience and may not reflect real-time hours, availability, pricing, or offerings.
03Intellectual Property
The following provisions protect the proprietary elements of the Platform. These elements are owned by My Harvest List and are protected under United States and applicable international copyright, trademark, trade-dress, and trade-secret law.
Proprietary Assets — Protected
All right, title, and interest in and to the following are and remain the exclusive property of My Harvest List:
- The Platform's source code, front-end architecture, and user-flow design, including the "pluck-to-basket" interaction model and the shareable-itinerary link system.
- The dynamic district-grouping methodology used to organize venues into curated geographic districts.
- The itinerary routing architecture, including the logic that orders, groups, and maps multi-stop trips.
- The fair-rotation placement engine, including the Fisher-Yates shuffle implementation, the winery-hospitality interleave algorithm, and the session-stable Featured ribbon system.
- The Platform's visual identity, including the grape-cluster mark, tier-badge system, color tokens, and typographic system (collectively, the "Trade Dress").
- All curated descriptions, editorial copy, and compiled data sets authored by My Harvest List.
You may not copy, reproduce, reverse-engineer, scrape, frame, mirror, or create derivative works from any protected asset without our prior written consent. Venue names and third-party marks are addressed separately in our Disclaimer.
03.1 — Platform Terminology & Interface Elements
My Harvest List utilizes proprietary agricultural-themed interface elements and software terminology throughout the Platform. The following terms and elements are proprietary platform terminology owned by My Harvest List and used to describe software functions and user interactions within the Platform:
- Harvest / Harvesting / Harvested;
- Pluck / Plucking;
- Basket;
- Trips Cart;
- the grape save icon and associated save-state iconography;
- itinerary-building interactions, including the pluck-to-basket flow, trip composition interface, and shareable-link generation system.
These terms and elements are creative and functional conventions of the Platform. Their use does not confer any rights upon users, partners, or licensees to replicate, adapt, or commercially exploit such terminology or interface design outside the Platform without the prior written consent of My Harvest List.
03.2 — Venue Profile Compilation Rights
My Harvest List may create, maintain, edit, and publish baseline venue profiles using any combination of the following:
- publicly available information about venues operating in Woodinville wine country and surrounding areas;
- information obtained under license from third-party data providers;
- information submitted directly by business owners or their authorized representatives;
- editorially created descriptions, categorizations, and curated content authored by My Harvest List.
Compiled venue profiles, including the selection, arrangement, editorial framing, and categorization of venue data, constitute original works of authorship owned by My Harvest List. Venue owners may request correction, profile claim, modification, or removal of their listing through the process described in the Disclaimer. Submission of a removal request does not affect any separately purchased paid participation agreement.
03.3 — Planning Intelligence & Analytics Ownership
Planning Intelligence, Planning Behavior Data, venue-pairing analytics, district-transition analytics, route-composition analytics, trip-composition analytics, benchmark reports, trend reports, planning-performance metrics, and related derivative analytical outputs generated by the Platform (collectively, "Planning Intelligence") constitute proprietary intellectual property and confidential business information of My Harvest List.
Planning Intelligence is created through the aggregation, organization, analysis, modeling, and interpretation of Platform activity, venue relationships, district interactions, and itinerary-building behavior.
My Harvest List retains all right, title, and interest in and to Planning Intelligence, whether displayed internally, provided to participating partners, incorporated into reports, used in Platform features, or licensed pursuant to a separate written agreement.
No user, partner, venue owner, destination marketing organization, enterprise licensee, contractor, or third party acquires any ownership interest in Planning Intelligence by virtue of using the Platform, participating in the Platform, purchasing a participation level, or receiving analytical reports.
03.4 — Illustrative & AI-Assisted Media
Certain venue profiles, editorial pages, district guides, route guides, or other Platform experiences may utilize illustrative, AI-assisted, generative, conceptual, or placeholder visual assets when official venue media is unavailable.
Such imagery is provided solely for visual continuity, user experience consistency, editorial presentation, and Platform functionality.
Illustrative, AI-assisted, generative, conceptual, or placeholder imagery is not intended to depict the actual appearance, architecture, interior design, amenities, offerings, products, services, operational conditions, or physical characteristics of any venue unless expressly identified as official venue media.
Users should not rely upon illustrative or placeholder imagery when making visitation, purchasing, reservation, or travel decisions and should consult official venue materials where available.
Venue owners and authorized representatives may request replacement, correction, or removal of illustrative or placeholder imagery through the correction and claim procedures described in the Disclaimer.
04Acceptable Use
You agree not to use the Platform to:
- Violate any law or the rights of any third party;
- Scrape, harvest, or bulk-extract venue data or compiled listings by automated means;
- Use any portion of Platform content — including venue profiles, compiled data sets, editorial copy, district groupings, itinerary outputs, or planning-behavior data — for the purpose of training, fine-tuning, or otherwise developing any artificial intelligence model, large language model (LLM), machine learning system, or automated inference system, without the prior written authorization of My Harvest List;
- Ingest, index, or incorporate Platform content into any vector database, embedding store, retrieval-augmented generation system, or semantic search index without prior written authorization;
- Create or contribute to any machine learning dataset, training corpus, or benchmark evaluation set using Platform content without prior written authorization;
- Use automated agents, bots, crawlers, or enrichment pipelines to replicate, mirror, or systematically extract the Platform's compiled venue database or any substantial portion thereof;
- Interfere with, disrupt, or place undue load on the Platform's infrastructure;
- Misrepresent your affiliation with the Platform or any listed venue;
- Submit fraudulent partner applications or payment information.
We reserve the right to suspend or terminate access for conduct that violates these Terms.
05Partner Participation & Billing
Businesses may participate in My Harvest List through one of several participation levels. Paid participation levels help businesses become more visible during the visitor planning process. Billing is handled securely by our third-party payment processor, Stripe, Inc. By purchasing a paid participation level, you also agree to Stripe's applicable terms. We do not store full payment card details on our servers. By completing checkout and accepting these Terms, paid partners expressly authorize My Harvest List to initiate recurring charges to the payment method on file at the applicable participation-level rate, on the applicable billing cycle, until the participation level is properly cancelled in accordance with the cancellation provisions set forth in this Section.
Participation Levels & Pricing
Participation levels are offered at the following rates. All prices are exclusive of any applicable taxes:

Rates are disclosed at the point of purchase and remain in effect for the duration of the selected participation level unless changed with notice.
90-Day Partner Term
Paid participation levels require an initial 90-day partner term. Trip planning happens over time. Visitors discover places, save favorites, build itineraries, and share plans before they arrive. A 90-day initial partner term gives businesses time to participate in that planning cycle and generate meaningful results. After the initial 90-day term, paid participation converts to month-to-month unless otherwise stated at checkout or in a separate written agreement.
After the initial 90-day partner term, cancellations require 30 days' written notice submitted to hello@myharvestlist.com. Cancellation takes effect at the end of the billing cycle following the 30-day notice period — meaning partners may be billed for up to two additional cycles after notifying us. For example: if your billing cycle resets on the 1st and you cancel on June 5th, your 30 days end July 5th, and your subscription ends July 31st. You will be billed for both June and July. Fees already paid are non-refundable except where required by law.
Washington State Sales Tax
Paid participation levels provide enhanced visibility, profile features, trip-planning integrations, and promotional opportunities within the Platform. To the extent these services are excluded from Washington State Retail Sales Tax under applicable Washington Department of Revenue rules, no retail sales tax is collected. Where any tax is determined to apply, it will be itemized at checkout or invoiced separately. Partners remain responsible for their own Washington Business & Occupation (B&O) tax obligations on their gross revenue.
06DMO & Enterprise Access Notice
Destination Marketing Organizations, tourism boards, development groups, and enterprise licensees may be granted expanded access under a separate written agreement. The following restrictions apply to all such licensees in addition to these Terms.
License Restrictions — Non-Compete
Licensees and enterprise partners are expressly prohibited from:
- Transferring, sublicensing, reselling, or assigning any portion of the Platform's intellectual property to any third party;
- Using the Platform's district-grouping methodology, itinerary routing architecture, fair-rotation engine, or user-flow design to fund, build, train, or operate any competing product or service;
- Extracting compiled data or design systems for the purpose of replicating the Platform's functionality, whether directly or through a contractor or affiliate.
These restrictions survive termination of any access or license agreement.
07Disclaimers & Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that venue information is accurate, complete, or current. Your use of any venue's services is solely between you and that venue. See our Disclaimer for affiliation and fair-use disclosures.
To the maximum extent permitted by law, My Harvest List shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
08Governing Law & Contact
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute shall be brought in the state or federal courts located in King County, Washington.
